Developer’s Toolbox: Tips of the Trade for Construction Contracts

This informative workshop will feature two segments: Part I. Negotiating Construction Contracts: Avoiding Common Pitfalls; and Part II. Understanding Construction Risk and Insurance: Liability Risk and Insurance. You’ll learn how to advocate for your position in negotiating professional service contracts during this seminar, which will cover the highly complex (and often misunderstood) world of construction contracts. While a great deal of time is often devoted to negotiating loan documents and partnership agreements, little – if any – energy is spent on negotiating the construction contract. This can lead to unfortunate and shocking results if something goes wrong during construction—as it often does. This seminar will cover the most significant issues in construction contracts. Most importantly, this workshop will address the interplay between construction work (i.e. what is going on at the project site) and the implications this has on the overall project (i.e. potential impacts on financing, tax credits, and insurance requirements). On the insurance side, we’ll learn about risk concepts, how to speak “insurance,” pre-development concerns, insurance during development, contractual risk transfer, certificates of insurance, and the current state of the insurance market.  This seminar is presented in partnership with SCANPH members Goldfarb & Lipman LLP and Gallagher.
