Inclusionary and Fair Housing: Oh My! The Courts Weigh In

 

To the excitement of the affordable homes community, the California Supreme Court upheld inclusionary zoning in a decision expressing strong support for affordable housing solutions. And, to the surprise of court watchers, the U.S. Supreme Court upheld disparate impact claims under the Fair Housing Act, spurring HUD to follow with its regulations for “affirmatively furthering fair housing.” Panelists will discuss this new legal landscape and what inclusionary ordinances, local zoning, and the location of affordable developments mean for cities, developers and advocates.
