Learn how to advocate for your position in negotiating professional service contracts at a new workshop that will cover the highly complex (and often misunderstood) world of construction contracts. While a great deal of time is often devoted to negotiating loan documents and partnership agreements, little—if any—energy is spent on negotiating the construction contract. This can lead to unfortunate and shocking results if something goes wrong during construction—as it often does.

 

This workshop will cover the most significant issues in construction contracts, including liquidated damages, construction scheduling issues, payment issues, public funding requirements, and insurance. Most importantly, this workshop will address the interplay between construction work (i.e., what is going on at the project site) and the implications this has on the overall project (i.e., potential impacts on financing, tax credits, and insurance requirements). Speakers will highlight some hidden risk allocation provisions and other clauses that appear harmless, but, in fact, fundamentally alter the owner’s expectations.
